National legislation in the Netherlands is very strict with regard to family reunification. This is different if you cross the border as a Dutch national to another EU Member State. Or if someone from another EU member state settles in the Netherlands. Then we no longer have to deal with Dutch legislation, but with EU law.

EU law is often the only way out for people who are bound by certain requirements within Dutch legislation, such as income requirements or that the partner is unable to pass the basic exam. The public order criteria also often play an impediment here, while EU legislation takes a more lenient view of this. We also call this the Belgium route or the EU route. A requirement is that they have lived together in the EU country for at least three months before they can return to the Netherlands.

De nationale wetgeving in Nederland is zeer strikt wat betreft gezinshereniging. Dit is anders als men als Nederlander de grens over gaat naar een ander EU lidstaat. Of als iemand van een ander EU lidstaat zich juist vestigt in Nederland. Dan hebben we namelijk niet meer met de Nederlandse wetgeving te maken maar met het EU recht. 

Het EU recht is vaak de enige uitweg voor mensen die binnen de Nederlandse wetgeving vast zitten aan bepaalde eisen, zoals de inkomsteneisen of dat de partner niet in staat is om te slagen voor het basisexamen. Ook de openbare orde criteria speelt hier vaak een belemmering terwijl bij de EU wetgeving hier milder naar wordt gekeken. Dit noemen we ook wel de Belgie-route of de EU-route. Een vereiste is wel dat er minimaal drie maanden samen wordt gewoond in het EU land alvorens men kan terugkeren naar Nederland.
